NATIONAL CONSULTANT -TO DEVELOP A PRACTICE DIRECTION FOR CODE OF CONDUCT TRIBUNAL

BACKGROUND OF THE ASSIGNMENT
As Africa’s most populous country and as one of the world’s fastest-growing economies, Nigeria is not immune to corruption challenges. Over the past decades, Nigeria has developed an impressive array of legal frameworks and set-up numerous institutions to combat corruption more effectively. Nevertheless, Nigeria continues to struggle with the impact of corruption on the day-to-day lives of its citizens. Corruption undermines the Government’s ability to provide public services, rule of law and public security. Corruption directly affects the well-being of the country’s population and its ability to rise out of poverty. With support from the European Union, the United Nations Office on Drugs and Crime (UNODC) is implementing a project on “Support to Anti-Corruption in Nigeria” (FED/2012/306-220)(NGAX60) involving fourteen (14) beneficiary Agencies.

One of the Agencies receiving support under the project is the Code of Conduct Tribunal (CCT). CCT is a quasi-judicial Agency which together with its sister Agency, the Code of Conduct Bureau were established by the Code of Conduct Bureau and Tribunal Act 1989, with the mandate of ensuring a high standard of morality in the conduct of government business.

Purpose of the Assignment
The consultant is expected to support the Code of Conduct Tribunal in developing a Practice Direction to improve the administration of its trial proceedings.


DUTIES AND RESPONSIBILITIES
Specific Tasks to be performed by the consultant:
Under the direct supervision of the Deputy Project Coordinator and in direct collaboration with the Chairman of the Code of Conduct Tribunal, the consultant will perform the following duties:
Review the constitutional and legislative provisions relating to the rules of procedure for CCT;
Consult with the management and staff of the CCT on procedural challenges which can be addressed through a practice direction;
Develop a draft “Practice Directions for the Code of Conduct Tribunal”;
Moderate a stakeholders meeting to review the draft “Practice Directions for the Code of Conduct Tribunal”;
Finalize the draft “Practice Directions for the Code of Conduct Tribunal” and present to CCT.
Expected tangible and measurable output(s)
The consultant is expect to produce the following tangible outputs:

Practice Directions for the Code of Conduct Tribunal; and
Report on the process including stakeholder consultations and meetings.
All the outputs should meet the satisfaction of UNODC, as assessed by the Project Coordinator – Support to Anti-corruption in Nigeria project, according to the following indicators:

Adherence to the methodology and workplan agreed to with CCT and UNODC;
Quality of the documents produced; and
Timeliness of delivery.
Individual consultants will be evaluated using the cumulative weighting methodology. When using this weighted scoring method, the award of the contract should be made to the individual consultant whose offer has been evaluated and determined as:

Responsive/compliant/acceptable, and having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation;
Technical Criteria weight: 70%;
Financial Criteria weight: 30%.
Only candidates that obtain 70 percent in the technical evaluation, will be requested to submit a financial bid.
Required Skills and Experience


EDUCATION:
Postgraduate qualification in Law.

EXPERIENCE:
At least 10 years of experience in litigation, criminal proceedings, court procedures rules and practice directions.

Competencies
Excellent legal drafting, writing and proofreading skills;
Ability to work in a multi-cultural environment;
Excellent oral and written English Language skills.

Language:
Fluent in English.
